Terms of Use & Disclaimer

These Terms constitute a legally binding agreement between you and Cleat & Pintle LLC, an Iowa limited liability company doing business as Elephant Trace. By checking the acceptance checkbox, you agree to these Terms in their entirety.

Elephant Trace is an Elopement Terrain Intelligence (ETI™) system. The Service accepts a residential or institutional address, processes public geographic and aerial imagery datasets, and compiles a structured visual safety blueprint depicting terrain features within proximity zones around the address.

3.1 Preparedness Aid, Not an Active Safety System. Elephant Trace is a passive emergency preparedness tool. It is not an active tracking system, monitoring device, physical restraint system, or emergency dispatch network. It is never a substitute for active human supervision.

3.2 No Guarantee of Completeness or Accuracy. Hazard maps are compiled from NAIP imagery and OpenStreetMap contributors on an as-is basis. We make no warranty that all hazards are identified, that data is current or accurate, or that the blueprint reflects present-day conditions. You are solely responsible for verifying accuracy before relying on it.

3.3 Not Medical or Professional Advice. No component of the Service constitutes medical diagnosis, behavioral therapy guidance, professional risk-management consulting, or official emergency management planning.

3.4 Not a Substitute for Emergency Planning. An Elephant Trace blueprint supplements — it does not replace — a formal wandering-prevention or elopement response protocol.

4.1 Ephemeral Profile Processing; Limited Document Retention. The structured address, behavioral indicators, and descriptive traits you input ("Profile Data") are used strictly in temporary active memory to render your output file and are never written to any persistent database. The rendered output itself — your poster and pocket card, which are visual documents that reproduce the information you entered — may be stored on our servers temporarily to fulfill physical print orders and to allow you to re-download your files. Rendered poster and card files are permanently deleted within fourteen (14) days of generation. For physical orders, the rendered document is transmitted to our third-party print provider solely to produce and ship your order. We do not sell this content or share it with any third party except as necessary to fulfill a print order you place.

4.2 Scan Record Retention. To operate the Service, fulfill your order, and allow you to re-download your files, we temporarily retain a scan record containing the address you entered, its map coordinates, and the resulting hazard analysis. This record does not include your child's name, description, or profile, which remain in temporary memory only (Section 4.1). Scan records and any rendered documents are permanently deleted within fourteen (14) days.

4.3 PII and Marketing Data. Name and email collected at checkout are used strictly to manage transactions and, if you opt in, deliver updates. We do not sell or share your contact information. You may unsubscribe at any time.

4.4 COPPA Compliance. We do not knowingly collect personal information from children under 13. Contact contact@elephanttrace.net immediately if you believe a minor under 13 has submitted data.

4.5 Authority Representation. By initiating a scan, you represent that you are the parent, legal guardian, or authorized representative of the individual or facility being analyzed.

5.1 Personal License. The Elephant Trace name, Elopement Terrain Intelligence (ETI™) mark, logos, code, layout frames, and website elements are the exclusive property of Cleat & Pintle LLC. Upon payment (or file generation for the free tier), you receive a personal, non-commercial license to print and distribute your blueprint for household and emergency preparedness purposes only. Map data includes © OpenStreetMap contributors (ODbL) and NAIP imagery (USDA public domain).

5.2 Institutional/B2B License Carve-Out. If you are a school, healthcare facility, therapy practice, group home, first responder agency, government entity, or other institutional purchaser, you receive a limited institutional license to reproduce and distribute your purchased blueprint(s) internally to personnel directly involved in the care, supervision, or emergency response of the individual(s) named in the blueprint. This institutional license does not permit: (a) resale of blueprints to third parties; (b) redistribution to organizations other than your own; (c) modification and republication of blueprint content as your own product; or (d) use of Elephant Trace branding or the ETI™ mark in your own materials without prior written authorization. Institutional use beyond this scope requires a separate written agreement. Contact contact@elephanttrace.net.

Digital PDF files ($9) are final and non-refundable once downloaded. If a technical error prevents delivery, contact support within 7 days for re-issuance. Physical printed posters ($24) may be returned unopened within 30 days of delivery (minus shipping costs). Contact support before returning. Iowa sales tax applied where required.

7.1 No Liability for Elopement Incidents. To the maximum extent permitted by law, Cleat & Pintle LLC and its agents shall have no liability for any elopement, wandering, injury, drowning, traffic incident, or death, regardless of whether an Elephant Trace blueprint was used.

7.5 Essential Basis. These limitations are an essential element of the bargain. Without them, we could not offer the Service at these price points.

8.1 Indemnification. You agree to indemnify and hold harmless Cleat & Pintle LLC and its officers, agents, and successors from any claims, damages, losses, or legal fees arising from: your use or misuse of the Service; your distribution of blueprints to third parties; your violation of these Terms; fraudulent representations regarding your legal status; or your violation of any privacy, child safety, or data protection laws.

8.2 Third-Party Downstream Dissemination. When you share, distribute, post, transmit, or otherwise provide your blueprint to any third party — including but not limited to first responders, school personnel, neighbors, family members, caregivers, or any emergency service — you do so entirely at your own discretion and risk. Cleat & Pintle LLC's duty of care runs exclusively to you as the purchasing party. We owe no duty of care, implied warranty, or fitness representation to any downstream recipient. You are solely responsible for: (a) ensuring any recipient understands the limitations described in Section 3; (b) ensuring the blueprint reflects current, accurate conditions before dissemination; (c) ensuring any user-supplied script is appropriate for the recipient and context; and (d) any action taken or not taken by a downstream recipient in reliance on the blueprint. This limitation survives termination of your agreement with us.

By checking the acceptance checkbox, you confirm: you have read and understood these Terms; you agree to be legally bound; your electronic submission constitutes a valid signature under E-SIGN and Iowa law; and you are at least 18 years of age with full legal capacity to contract.

10.1 Third-Party Geospatial Data. The Service relies on OpenStreetMap (© OpenStreetMap contributors, ODbL) and NAIP aerial imagery (USDA, public domain) — frameworks we do not control. We are not liable for outages, inaccuracies, omissions, or changes in third-party data sources. Hazard identification is derived algorithmically from these datasets and may not reflect present-day terrain conditions. You are responsible for independent verification before relying on any hazard identified in your blueprint.

10.2 User-Supplied Script and Content Disclaimer. Any de-escalation scripts, behavioral profiles, emergency instructions, physical descriptors, or other free-text content you enter into the Service is compiled into your blueprint exactly as written, without review, editing, or verification by Cleat & Pintle LLC.

We reserve the right to modify or discontinue the Service at any time. Updated Terms will be posted at elephanttrace.net/terms. Continued use constitutes acceptance.

These Terms are governed by the laws of the State of Iowa. Disputes must first be submitted to 30-day informal negotiation before formal proceedings. Venue is exclusively in Iowa state or federal courts.

These Terms constitute the entire agreement between the parties. If any provision is found unenforceable, the remainder continues in full force. Iowa force majeure exemptions apply.
